Apologies if I should have looked this up somewhere within IV .
Guess it is a simple question.
What does a soft LUD mean ? I have often read that term on the forum.
I at times see that something was updated on my case..."last updated date" but then there is no status update.....for example this happened on my I131 application on Feb 4, 2009
On the I485 I think it is just that they transferred it from one office to another as the status says.

hi,
thanks to everyone here for the kind input, I am almost done with my GC application under NIW. Since I have a load of documents for primary evidence,
how should I arrange them and where should I mention the "table of contents" so to speak. I have a detailed cover letter also.

INS prefers or should I use the term "requires" a certain way of organizing documents using certain clips. You can search online for them. They do this because it helps in filing them the documents at their office.

Hi,
Applied for EAD renewal on 6/11/2008. Should I get it for 2 years or 1 year.
My understanding is everything that gets processed after 6/30/2008, will be for 2 years.
My PD is 6/12/2006, EB2 - which is not current right now, and I don't expect it to be current, until my I-765 gets processed (Well if it becomes current I guess I don't need 2 years :) )

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

What is unemployment wage report? I read that many visa seekers were asked for this.
Also, they were asked for a notarized list of all the employees with their job title, salary and immigration status. Wow now to get salary information for everyone is breach of privacy.

Just hold on to those papers and make them available when they travel back in future.

AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.

Hello,
I got here on K-1 visa on 05/03/2010. Got married 07/03/2010. Got my SSN and applied for I-485, I-765 within the timeline. Received RFE for co-sponsor as my wife's salary wasn't enough. Her dad was suppose to do it but stepped back. When we filed I 485 & I 765 we also sent the I864A form which is a contract between the household member and the sponsor. But now we did not send it cuz we have moved out. She lost her job just one day before we responded to RFE but we still sent her work documents cuz they were already in motion as when we applied for it we sent her work info. My friend co-sponsored and we responded to RFE within the timeline. Received an update that the decesion will be made in 60 days. Not sure they will approve it because my co-sponsor's salary is only $24,000 per annum. The question is, if they deny then we will apply for MTR and they deny that too then do I have to leave from USA because I can't leave my wife like that cuz she has nobody after me here as she already got seperated from her family too as I did. We are very young. I am 23 and she is 19. We got married to have a dream to live together forever. I can't take her back with me to India cuz she is highly lactose intolerance person, doctors said she might die if she goes there cuz our food is 99% dairy. Please help...

The American Immigration Lawyers Association (AILA) has applauded the brainstorm of ideas in a draft memo from the United States Citizenship and Immigration Services (USCIS). The now-public draft, leaked without the permission of USCIS, examines the legal framework of immigration and explores possible solutions. AILA commends this reflection of the pursuit of the rule of law and the willingness of USCIS leadership to take up this thorough examination.
"We have in the past seen many attempts to scour the law to find justification for draconian, and ultimately unhelpful, ways to make immigrants' lives miserable," said AILA president David Leopold. "This draft document tries to think through ways to make the legal immigration system work in support of sensible law enforcement. It respects the law and respects the people who must deal with the law. For that, the administration is to be congratulated, even if none of the proposals is ever carried out." He added that many of these proposals should be carried out. Long-needed regulations to help children and crime victims caught in the system should be published. Men and women fighting for America in the U.S. military should have the comfort of knowing that their families are safe from being deported. Immigration policies that encourage investment in America and creation of jobs should be emphasized and expanded. These are but a few of several excellent proposals in this document.

When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.

They are not liable to pay from the the day application was sent.
Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.
In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

I came across a posting today for a local contract position, which was a good match for my profile. But when I sent my resume in, the vendor said we cannot proceed because the end client asked for either citizens or GCs. I thought it was strange, because it is a contract requirement, not fulltime. This is the first time that I have encountered someone requiring a GC for a contract posiiton. Further, this is not a defence or state department kind of deal where you'd need citizens. I would understand if they said 'citizens only', but GC or citizen does strike me as unconventional.
Can someone please advise if this is allowed by law?
