My H1B extension was approved for only 6 months, based on the SOW (Client Contract) end date (rather than the usual 3 year extension).
I would be just about in my maternity leave for the pregnancy during the petition expiry and if my further extension is denied (god forbid), I was told that I would be terminated from my employers' payroll and I have to leave the country or change my status to Student, Visitor etc.
FYI: I'm working for this company since Oct 2005.
Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.
I have traveled by Emirates several times (last year was the recent one) and they did NOT require a transit visa.

As always thanks for all of your help who are out there and lending a hand to each other in this immigration mess.
After denial of I-140 (EB3) in November of 2007 in response to my A2P RFE, I filled for appeal in December 2007. Now my case is in appeal with AAO. My H1b is expiring in June 2008. I am hoping to get an extension based on my pending appeal.
In the meantime, another company has offered me a job and agreed to file the labor of my behalf. In the current situation of mine, where appeal is pending, which will take a long time for the final decision, my lawyer suggested to file the new labor through that company and this time under EB2 catagory. I dont have masters degree but I have BS computer science and now more than 5 years of US experience. He suggested EB2 since for my home country EB2 is always current.
I just want to get an opinion for all of you about this situation of mine, and filing labor under Eb2 cat under PERM. The position in the new company is Senior Security Analyst and requires Masters degree or 5 years of experience.
Also , what is the process of getting extension on H1b while appeal is pending and how early should I file the extension before June 2008.

Does anyone have any insights or theories on why PERM processing is so badly delayed at Atlanta? And why are applications being processed out of order? People who filed in Jan 06 are getting approved while those who with priority dates in 2005 are still waiting. Does anybody have ANY idea? There should be some transparency in the process. It's just a black box right now and that makes the process ten times more frustrating.

What my lawyer said was correct. Yesterday evening received the approval email and card production email. In the case of same employer, interfiling is not necessary. USCIS took care of it automatically.

Well they could hurry up and approve my eb1-c that's been pending for 8 months despite them saying 4 is their target! I can't see how they can say not enough applications when they are way off their targets for poor souls like me. I've put in an SR so we'll see what happens

Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.
But when he filed my h1b i was in india.
i came to us on June 2009 on H4 visa.
can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.

I have probably a strange case .In 2007 when all the dates were current my employer filed I-140 & I485 at the same time in EB2 . I have received AP and EAD both according to standard procedure.I have maintained my H1B status. Then after a month or so I have received I-140 rejection due to different job requirement and I am overqualified for the job so my attorney interfiled new I-140 under EB3 without worrying about I 485 thinking since I 140 is denied it should nullify I485 under EB2 . In the mean time USCIS sent me a new I-485 receipt # . I got my I 140 approved in another six months under EB3 and now I have two I 485 receipt numbers as well as two A numbers. Both of the receipts when I checked the status show that it is under initial review. Shall I call USCIS and get rid of the initial I485 which is under EBII . Anyone had this kind of experience??

There is 180 days rule for h1b without pay and also it is employers responsibility to pay when you are out of project. Also think about option of switching her back to h4.

Hi,
I graduated on May 2008 with an MBA degree. My OPT started in Jul 2008 and is valid till Jul 2009. I am not eligible for 29month extension.
I was on an internship till Jan 30th 2009 and am looking for fulltime positions now.
I understand that I will have to file for H1 on April1st and I can stay in the US and work legally if my H1B is still in process under the cap-gap rule passed last year.
How long can I legally stay in the US on OPT without a job?
Can anyone please throw light?

Alien registration number is found either on I-140 receipt/approval on top of beneficiary's name. If you're not sure, just leave it blank or put N/A. This is different from I-94 number.

Yes, you can use it for multiple entries (The I-512L should say "this is valid for multiple entries" or something to that effect). But, please be prepared to answer the questions (if any) on what is the necessity to travel on an AP 3 times within the year. If it is on business, that is perfectly within the stated rule. But, if it is vacation, you may be questioned (that is dependent on the individual officer).

Like PMAT mentioned, I-539 is to be used, and you can do it by yourself, if you'd like. Download the latest form from http://www.uscis.gov/files/form/ (immigration forms).
You will need, I-129, photocopy of your passport, your I-94 (current), Photocopy of Marriage certificate.
