Senator Arlen Specter (R-PA), chair of the Senate Judiciary Committee, has just introduced an immigration bill that would reward virtually all of the 10.2 million illegal aliens estimated to be in the United States as of January 1, 2004.
Sen. Specter's immigration bill would reward these more than 10 million illegal aliens with exactly what they broke U.S. law to obtain: permission to work in the United States indefinitely. A significant number of the estimated 1.2 million illegal aliens who have entered the United States since Jan. 1, 2004, along with some of those who enter in the future, also would likely be able to obtain amnesty through fraud. (Experts have found that the fraud rate in the 1986 amnesty was as high as 70 percent.)

I want to apply for AP but I'm not sure if I qualify and I don't want to get rejected as I cannot afford to lose the money. I am here on F-1 visa and got married and subsequently have applied for I-485 and got receipt for it.
1. Can I apply for advanced parole?
2. I want to go home and visit family and/or have AP in case I need to leave. Is this a valid reason? Is this what I write as my reason on form?

The DREAM Act could come up for a cloture vote as early as this week, but faces tough opposition from Republicans -- including a few who, like McCain, previously supported the bill.
Some will likely vote against the DREAM Act citing timing. Senate Majority Leader Harry Reid (D-Nev.) plans to bring up the bill for a cloture vote as early as Wednesday, but all 42 Republican senators have said they would filibuster any bills not related to tax cuts.
As the Senate struggles to come to agreement on the tax cuts and other issues, the DREAM Act could lose its few Republican supporters. Sen. Richard Lugar (R-Ind.), a co-sponsor of the DREAM Act, would vote against the bill if it came up this week, spokesman Mark Helmke said.
"You have to handle the spending bills, tax legislation and START first," Helmke said. "If we get those three things, he's willing to stay in and take up the DREAM Act."

Hello All,
I need your advice. My H1B for first 3 years is expiring in Sep 09. I am a consultant and my project is till June 09. So I will be on bench after that till I get a new project. So if I have to file for extension should i file it now when I am in project or should i wait.
When I asked my employer about filing extension, they told that they are getting lot of queries these days. They even told be if my project is getting over early then its difficult to get an approved extension as these days they even have to send the contract letter of clients which do states that when my project is going to end.
So i need to know what are my options.
When Should I file for extension and is there any other options.

Same boat. My brother's marriage is in the last week of August and I have to travel to India.
When I go to India, I will need to get H1b stamping on extension - will that be an issue?
If I apply for 485 now, and they send biometrics notices when I am in India (will be there for a week in last week of August) , will it be an issue? Though it is a long shot?
Changing address - I will be moving into a new apartment soon (in 3 months) - so effectively after applying 485, I will be moving to a new apartment - how will I handle address change?
Can anyone help me with these answers :)

I think even if employer revokes or cancels and if you have approval copy of I-140 you can port the date. Please consult some good immigration attorney.

Hi,
Thanks FactoryMan. I had a similar question. My thought is that if the spouse is a dependent, then it shouldn't matter what status s/he is, as long is it is legal.
The next question is, suppose we apply for EAD, but the spouse's current student status expires before receiving the EAD, do they fall out of status?

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???
Is it safe to work on ead of one gets 2 year ead with pending 140.??

I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.
Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.
I understand that they receive 1000s of applications but that is no excuse for incompetence. As of July 31st, it was taking them 1 year and 4 months and now it is 1 year and 6 months to process I-140.
Why don't they re-institute expedited I-140 approval?

Convert to H4 if spouse is on H1B. Chances of getting F2 approval are also high if spouse is on F1 and has not applied for I-140 (even if F2 is approved you should not go out of the country for stamping as the embassy will not issue visa due to intent to immigrate). Greencard processing can continue in the meantime as it is process for future job offering.

I believe when DOS calculated the Eb2 China demand data for July, they might have taken all apps pending from Nov22 2005 till Dec 31 2005. Considering the apps prior to Nov 22 2005 as demand for June 2010.
Same for Eb2 India from Feb1 2005 till Dec 31 2005. To make note is India dates did not change in June so the demand remains the same for that year.

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.

Are you working now? Consult any immigration lawer on the steps to follow on the H1 transfer. I am not sure if there is a clause that you should have worked on the current company few months and get the pay checks. Also to transfer H1, you need copy of your 797 and not original. You can get it from your employer or from the lawer who filed H1. Bottom line, the forum answers should be taken as only guidence and not advice. Consult a IM lawer to confirm anything before you act.

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
