I see nothing wrong in it. It is an honor for India that our Mahatma Gandhi is remembered and associated with the biggest movement in USA. Gandhi did not get a Nobel prize but people who got nobel peace prize at that time are forgotten and he is not. There are bigger issues than talking about greencards in congress.
Do you want Congress to only talk about EB 3 India retrogression and discuss March Visa bulletin? :D:D

My 140 (filed concurrently with 485) was approved on Aug 17th. Ever since 08/17 I have been seeing LUD's on it everyday. In fact there was a LUP on 08/19 Sunday! Any ideas what's happening? I think something is going in CIS.
I got a LUD on my November 2005 approved I 140 on 03/13/08. My I 485 reciept date is August 7th, 2007. I got all reciepts, EAD and FP notices. I am in EB3 category. Need to know why LUD on I 140. :confused:

In 2000, Congress authorized the use of 130,000 these �lost� visa numbers by what has come to be known as the �visa recapture� method. However, approximately 219,000 numbers have not been �recaptured�. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. A one‐time recapture of the 219,000 unused visa numbers could go a long way to eliminating this backlog and bringing much needed relief to many applicants who currently face the prospect of becoming residents of the United States after they retire.

I think u did not submitted your 485 application. You can only apply for EAD once u submit your 485 application. There are three stages of GC...Labor, 140 and 485...Once u have approved labor.. you need apply for 140 when your priority date is not current...When your priority date is current then you can apply for 140 and 485 together. Once you apply for 485 you can get EAD.
Only exception when you are on L2 Visa.

Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.
It was intially hard to predict when USCIS would resume PP for I-140. But now that they have stopped taking in 485 applications, they should be in a position to estimate their work load and provide guidance soon.

And also, I am looking at a big amount of money that I gotta pay for tuition, does anyone know any tax credits that we can use to reduce the burden ?

Yes, you can do part-time MBA without issues. There are tax breaks both at the federal and possibly the state level (NY has a tax break for students). The tax software will guide you thru it.

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

You must have I94 showing H1B classification and validity dates to change status to H1. You can travel and re-enter with a H1 visa stamp and obtain h1 status. Please check with the company attorney,

Technically yes. But USCIS looks at cases under a microscope when they see multiple applications from a same applicant. And if the the sponsor is a small firm, you can expect some careful screening. Increasingly USCIS is making efforts to ensure GC system is not abused by people. A lot of companies had in the filed for GC for several employees and GC applications for latter and sometimes former applicants were denied when it was found that the employer cannot show enough funds to support them. Take the risk only when you are sure. Lawyers will be happy to file multiple applications because they will get double their fees. BTW each lawyer generally makes you sign a contract beofre taking a case where the lawyer says that he cannot guarantee GC and if it is denied, lawyer takes no responsibility.
