I'm a mechanical engineering and also have an MBA degree.
I work as a support engineer.
My lawyers tell me that I cannot apply in EB2, since my Post grad degree is unrelated to my grad degree and so does not apply to my job.
Is this true?

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

came back to US on dec 30. Didnt get paid for the month of sept oct nov dec. But i was never out of status as I was in india. ... i have paystubs till aug 30 2009. never out of status
You actually were out of status since Dec 30 till this moment and you still are out of status. You are immediately out of status once you are not paid for the job or fired, regardless of the fact if employer revokes H-1 or not.
You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

If this is true then some of the concurrent filers will try to upgrade them to PP.I will be surprised if they do that. But crazier things have happened.
I really doubt it, with all the current workload, USCIS can't take I-140 PP. That will further slow down the receipts.They have enough work for this year. Providing receipts, EAD, AP etc for more than 100,000 applicants.

The Department of State has published a pamphlet educating nonimmigrant visa holders on their rights. The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

One of my relative did work in Vancouver, Canada with his GC. He got his work permit at Canadian port of entry. Anyway this was long back, so please do your research, rules might have changed since then.

Yes, unfortunately that is true. You can not use the experience that you gained with the current sponsoring emplloyer for your permanent residency application.

I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?

To my knowledge H1B extension is just like a new H1B application ofcourse 6 years window will be couted here and you have spent just 3 years. To me you can file H1B extension with multiple companies. But its better to file it with original company to be on safe side, onece the extension approval come ytou can trasfer it whereever you want.

Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...

You should just provide a valid reason for your case for the senator to help. All senators have direct lines to immigration offices. They can expedite your case and the results are astonishing.
My cousin left to india for an emergency and his AP was pending. Contacted senator and got it approved immediately in a day.
I also heard that one person got his 140 approved in a week. Not sure what reason he provided.
But senators are certainly helpful unlike Indian politicians.

Not sure if I will make the category, but feel that I should consult with a good immigration attorney and explore the option. Who knows? I wish there was a category for people who were doing the work that directly improved the lot of the American people. Not-for-profit is not lucrative nor glamorous, so there should be some incentives :)

This bill was passed as part of the Labor-HHS 2008 appropriation bill. Reportedly, this bill faces two roadblocks ahead to make it into a final legislation. One is the White House that has been threatening to veto the Labor-HHS bill in toto because of the amount of spending. Second is the House that has to agree to the Senate version in the conference committee. However, the second roadblock does not seem to pose any serious threat as demonstrated by the move of some of Democrats in the House. Please stay tuned.
