Left with no choice.. but to wait with hope..
Better to start new labor process if your are nearing 6th year on H1. these audits take forever and mostly have -ve results. and the employers/attorneys are not helpful either.

Note that EAD is not a valid document for re-entry.
If you have a valid AP - you can re-enter
or
If you have a valid H1/H4 AND un-expired visa stamping - you can re-enter
I had my H1 extension pending and I was able to re-enter using AP (on July 18, 2008 at San Francisco)
She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

I was joined as a contractor at CLIENT through client's preferred VENDOR. My paystub runs by my EMPLOYER. I use to submit my timesheets to my EMPLOYER and VENDOR every week. My EMPLOYER runs my paystub everymonth with minimum pay amount and not as per actual earnings. For ex:my actuals were $9500/- per month, he rans for only $6000/- every month. This gap is because he says he didn't receive the payments from VENDOR. With these gaps everymonth the dues between my employer and me has increased a lot, and my employer has to pay to me some $xx thousands dollars. There is no document/written evidence with me from my employer. My employer always tells me on phone, how much they paid to me and how much of mine they are holding.
After my contract completion(for ex:10/30/09) at CLIENT, I joined and started as a Full Time Salaried employee at CLIENT on 11/5/2009. I submitted my resignation to my previous EMPLOYER on 11/16/2009.
I have to collect my dues(ex: $xx thousands) from previous EMPLOYER. How can I proceed further to collect these dues, as there is no document / written evidence with me from him. My previous employer always communicate with me on phone to update the money transactions.
My current visa status is, I am a Green Card holder.
Please help me how to proceed in collecting my dues from my previous employer.

I am thinking of leaving my current employer & joining the primary vendor for the client, wondering if my employer can hold back last month's salary OR how people have handled such situations.

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)

I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?
LAC for H1B and LCA for Green card are entirely different .

I want to keep this thread on top for a while to see how many People with priority date between Jan'05 and March 28th '05(Filed under RIR/NON-RIR) applied again in PERM. The reason is lot of Friends i know applied their labor again in PERM since the Old Labors filed under RIR were sent to BEC Center's in Phily and Dallas for 'cold storage' and forgot to port the dates after the old labor approval since the time regained was not big enough.
This gives us an fairly good idea to see how quickly the dates would move from Jan' 22nd '05 as many fear there might a huge figure here who applied between December '04 and March 28th '05 under the old process and before PERM kicked in .
Please do not forget to mention if you have ported the dates from your old labor.

That will take some creative googling. Clearly, tech/South Asian professional associations are our best target audience, but at the very least you'll find regional associations -- Tamil, Telugu, who knows maybe even the Bengalis!
The other type of organizations to call are the development based ones (like Asha, Seva)-- they will at least know of other community organizations.
Is there anyone else out there in Seattle? Any ideas?

Its true that you have to have valid passport (which is not expiring withing 6 monts) at the time of visa stamping.
Get a new passport before you leave for India. You can apply for a new passport in India Consulates in USA. Google it and you will find out more.

Start with Libra. I have seen people talk, talk, talk and talk about immigraton and gone with the wind right next day they get the green card. Start with a member 'libra', he always used to blame eevrybody, not seen since the day he got his GC. Share some other names.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Hi,
My wife came to US on H4 and changed to F1 status thru COS. She is doing Masters 2nd semester and went for F1 visa stamping this week in India. She got 221(g) pink slip asking explain her projects, plans afer study etc. Visa officier withheld her passport and I20.
BTW the way I am on H1B and provided all the financial support documents.
I searched the online didnt any F1 getting 221(g) pink.
1)If anyone else got this for F1 please share your experiences and any tips.
2)How long it takes after repsonding to thier queries
3)what are the chances getting visa after getting 221(g) pink
4) Do you suggest getting any professional in drafting the reponse to te queries.. if so do you know any one in Hyderabad, India
